Terms of Service

The agreement between you and Counterfactual Limited when you use this website or one of our products.

Effective 18 September 2026. Applies to sameatoms.com and its subdomains, and to the Counterfactual apps for iPhone and Android.

1. Who you are dealing with

The website and the products on it — Cooking Videos, Reading, Deep Read and Read Mail (the “Services”) — are provided by Counterfactual Limited, a company incorporated in Hong Kong (“Counterfactual”, “we”). By creating an account or using a Service you agree to these terms. If you do not agree, do not use the Services.

2. Your account

You need to be at least 13 years old, or the age of digital consent where you live if that is higher, to have an account. Keep your sign-in method to yourself: whoever can read the email address on your account can sign in as you. Tell us at once if you think someone else has used your account. You may delete your account at any time; for products with a delete button, it is immediate.

3. Your content

Videos, links, books, articles, mail and anything else you put into a Service remain yours. You give us permission to store, process, transform and display that content — and to send the relevant parts of it to the AI providers we use — solely to provide the Service to you. That permission ends when you delete the content or your account, except for copies in routine backups, which expire on their own schedule.

You are responsible for having the right to use what you upload. Do not use the Services with content you are not entitled to copy or process, to infringe anyone's rights, to harass anyone, or to break the law. Where a Service fetches content from a publication with your own subscription, you remain bound by that publication's terms.

4. Output made by AI

Transcripts, translations, recipes, summaries, explanations, illustrations, maps and answers are generated by language and image models and can be wrong. They are aids, not authorities: check a recipe before you serve it to someone with an allergy, and check a summary against the original before you rely on it. We do not warrant that any generated output is accurate, complete or fit for a particular purpose. As between you and us, you own the output produced from your own content.

5. Credits, purchases and refunds

Cooking Videos is paid for in credits. New accounts receive a free allowance, which may expire; credit packs are bought through Stripe or, in the iPhone app, through Apple, and are not refundable once used. If a video fails to process because of a fault on our side, the credits are returned. If you believe you were charged in error, write to [email protected] within 14 days with the receipt and we will put it right. Purchases made through Apple are subject to Apple's refund process as well. Reading, Deep Read and Read Mail are currently provided without charge to invited users; we will give notice before that changes.

6. What we promise, and what we do not

We work to keep the Services available and their output useful, and we will tell you before removing a Service or a major feature. The Services are, however, provided “as is”: we do not promise they will be uninterrupted or error-free, and we may change them, suspend them for maintenance, or withdraw a feature. To the fullest extent permitted by law, our total liability to you for anything arising out of the Services is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect losses such as lost profits or lost data. Nothing in these terms limits liability that cannot be limited by law.

7. Ending the agreement

You can stop using the Services and delete your account at any time. We may suspend or close an account that breaks these terms, that we are required by law to close, or that has been inactive for more than two years, giving notice by email where we reasonably can. Sections 3, 4 and 6 survive the end of the agreement.

8. Apps from the App Store and Google Play

When you use one of our apps, the store's own terms also apply. Apple and Google are not parties to these terms and have no obligation to provide support or maintenance for our apps; that is on us.

9. Changes to these terms

We may update these terms. When we do, we change the date at the top; for changes that materially affect your rights we tell account holders by email at least 14 days before they take effect. Continuing to use a Service after that date is acceptance of the new terms.

10. Law and disputes

These terms are governed by the laws of Hong Kong SAR, and any dispute that we cannot settle by talking will be brought in the courts of Hong Kong. If you are a consumer in a place whose law gives you the right to be sued only in your own courts, that right is unaffected.
